Right of withdrawal and refund

If the Customer is a "Consumer", as defined in article 3 of the Consumer Code, he is entitled to the rights referred to in the articles. 52 et seq. of the Consumer Code, as amended by Legislative Decree dated 02/21/2014 n.21, and therefore the right to withdraw from the Purchase Contract within fourteen (14) days, starting from the day on which the Customer or a third party, designated by the Customer and other than the Carrier, acquires physical possession of the goods.
We remind you that, as required by current legislation, the right of withdrawal is excluded and cannot therefore be exercised if the products you have purchased have been personalized, even with simple engravings, or have been tailor-made for you, on your explicit request when placing the Order.
The Withdrawal may concern all (Total Withdrawal) or only part (Partial Withdrawal) of the Products purchased by the Consumer.
The customer who intends to exercise the right of withdrawal must communicate this via an explicit declaration by completing the withdrawal form and sending it to the contacts indicated or by accessing the website www.gioiellimoscariello.it in the "Request return" section and following the instructions contained therein.
The right of withdrawal is subject to the following conditions:
  • the returned Products must be returned in their entirety and not parts or components of them even in the case of kits;
  • the returned Products must not have been used, worn, washed or damaged;
  • Returned products must be returned in their original packaging (meaning, by this, the packaging of the individual product);
  • the returned Products must be sent to the Seller in a single shipment;
  • In the event that the returned product(s) has contributed to the achievement of a minimum order to obtain a gift, the return of the product means that the return of the aforementioned gift is also included and obligatory.
In case of exercising the right of withdrawal, the customer is required to return the goods within 7 days from the day on which he communicated his wish to withdraw from the Contract.
After logging in through the Site and entering your login credentials on the website www.gioiellimoscariello.it in the "ORDER" section, select the Order concerned and request the return. It is important that you contact customer service via email at shop@gioiellimoscariello.it to inform us of the reason for the return. If we receive a broken or damaged item, we will send the DHL courier who will proceed to collect the package entirely at our expense. If the item was not to his liking, the customer can choose to return the item at his expense via the service he prefers or request collection by our DHL courier, in the latter case the shipping costs will be deducted from the refund. return.
The goods must be returned intact, in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, etc.) and complete with the attached tax documentation. Without prejudice to the right to verify compliance with the above, the seller will refund the amount of the products subject to the withdrawal within 24 hours of receiving the product.
The Seller will use the same payment method used by you for the initial transaction for the credit, unless you explicitly ask the Seller for a different method to be used and the latter agrees. If the order was paid via Paypal, the refund will be made via Paypal to the account used for payment while if the Order was paid via Credit Card, the refund will be made to the card used for payment (it is not possible to use a other card for reimbursement). Returns are processed by customer service in approximately one working week. The reimbursement times on the card or on current accounts depend directly on the banks, which generally take around 2/3 working days for the credit.
In case of simple withdrawal the only costs to be paid by you will remain the initial shipping costs of the Order of the purchased products. All other expenses will be reimbursed to you by the Seller, including the costs of delivery of the goods returned following the exercise of the right of withdrawal (with the exception of additional costs resulting from your possible choice to use a different and more expensive delivery method than the standard delivery type offered by the Seller).
The only case in which the customer will be entitled to a refund of the price, shipping costs and return costs is for the return of defective products or products delivered that do not correspond to the Order placed by the customer or in case of damage to them due to transport or errors in shipping by the Seller himself. In the event of a return of the products listed above, the seller will bear the transport costs for returning the products. If possible, reseal the item or items to be returned inside the same box used for our shipment. If this is not possible, we recommend for safety reasons that the return is well packaged and protected. The courier will already arrive with the pre-printed label with our shipping data and customer reference.
